The procurement procedure is direct procurement. The basis for direct procurement is in accordance with Procurement Act 1397/2016. 7) The goods are procured under particularly advantageous conditions from a supplier that is winding up its business, from an administrator or from a liquidator in the course of insolvency proceedings, an arrangement with creditors, or corresponding proceedings; Based on written confirmation received from Moov Co, the device in question is being sold as part of a liquidation process resulting from the cessation of the supplier’s business activities. The sale is therefore not conducted under normal market conditions, and the device is no longer commercially available through standard procurement channels. The procurement satisfies the criterion of particularly advantageous conditions, as the offered purchase price of ~EUR 94,000 is significantly below prevailing market prices. Comparable new devices currently available on the market are priced in the range of EUR 300,000–450,000, indicating a substantial and objectively verifiable price advantage. The favourable conditions arise directly from the liquidation and are exceptional, non‑recurring, and time‑limited in nature. Due to these circumstances, it is not feasible to obtain equivalent conditions through a competitive procedure, nor can a similar economic outcome reasonably be expected at a later stage. Consequently, proceeding with direct procurement is considered economically justified, proportionate, and consistent with the principles of sound financial management, in particular the achievement of optimal value for money.
