In this procurement procurement act is not followed. According to Commission Decision (2006/422/EC), the Procurement Directive for specific sectors does not apply to contracts awarded by contracting entities such as for the purpose of enabling them to produce or sell electricity in Finland, with the exception of the Åland Islands. The procurement act does not apply in the procurement concerning Ämmässuo landfill gas power plant CHP 1, as ruled by the Supreme Administrative Court in Finland in 2013. Therefore, this procurement Peak Power Electricity Production with CHP 1 - Lot E: CHP 1 Gas storage piping works, electric works and installation of the process equipment contract 24414 is carried out outside the procurement act.
